Terms of Sale
By placing an order via www.timkellywriter.com (the “Website”) you agree to these Terms and Conditions of Sale (the “Terms”). Please read the Terms carefully before placing an order.
These Terms govern any and all contracts formed between you (the “Buyer”) and Tim Kelly (the “Seller”) via the Website. By clicking on the ‘Buy Now’ PayPal button you acknowledge that you have read and that you accept these Terms without any condition. Please be aware that your contract will be governed by the Terms present at the time of your purchase. Any purchase made seven (7) or up to seven (7) days before any alteration of the Terms will be governed by the prior Terms.
After you have placed your order, PayPal will send you an e-mail to confirm your payment. Please note that this e-mail does not constitute an order acceptance from the Seller and the Seller reserves the right to refuse any order. Once the order has been processed, a further e-mail will be sent to you as confirmation that your order has been accepted and is due for dispatch. The Seller is not obliged to accept your order and will not accept your order for reasons including, but not limited to the following:
• the goods are currently not in stock;
• your payment is not authorised;
• there is an error on the Website regarding the price or other details of the goods; or
• you have cancelled your order in the manner prescribed below (Cancelling and Returning Orders)
All prices are VAT (Value Added Tax) inclusive.
The Seller reserves the right to change the price of any items on the Website at any given time without notice.
All UK orders are delivered by Standard Royal Mail Delivery. The Buyer should expect the goods to arrive in 3-5 working days where the Seller shall use its reasonable endeavours to meet any agreed timeframe for delivery. In any event, time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
Cancelling and Returning Orders
In the event of a cancellation, please use the Contact Form provided stating “Order Cancellation” in the ‘Subject’ line and make sure to include your name, address and your order number in the ‘Message’ text field.
Orders can be cancelled at any time before being dispatched. Any orders being cancelled before dispatch will be refunded in full.
If the Buyer wishes to cancel the order after it has been dispatched, the Buyer will be required to return the goods at its own expense in the same unopened package and condition they have been received in. Once received, the goods shall inspected by the Seller and the Buyer will be accorded a partial or full refund depending on the condition of the goods at arrival.
Where the Buyer has received the goods and claims defects or damages to said goods, the Buyer is required to notify the Seller in writing within 7 working days from the date of the delivery and to provide proof in the form of photos or videos of the damage upon delivery where possible. If the Buyer fails to do so, it shall be deemed to have accepted the goods as non-faulty.
You guarantee that the information you provide to the Seller for the purpose of ordering goods is true and correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods that you have purchased.
Applicable Law and Jurisdiction
In the event of any dispute between the Buyer and the Seller, the laws of England, Wales and Scotland will apply. If you wish to take legal action against the Seller, you must do so within the United Kingdom.
The Seller will not be held liable for any indirect or consequential loss or damage arising out of any problem relating to goods delivered to you and shall have no liability to pay any compensation other than to refund you the amount paid for the goods upon their return. Please note that nothing contained herein limits any rights you have as a consumer under the laws of England, Wales and Scotland. Nothing in these terms and conditions creates any right which is enforceable by any person who is not a party to the contract between you and the Seller. The Seller shall have no liability to you for any failure to deliver the goods you have ordered or for any delay, damage or defect to goods delivered caused by circumstances beyond its reasonable control.
Tim Kelly may change the Terms at any time by amending this web page. All changes are effective immediately. Tim Kelly may, at his own discretion and at any time, modify or discontinue, temporarily or permanently, the Website or any part of it with or without notice.
